The Environmental Management Authority (EMA) did not consider the negative environmental impact that would be caused by the operations of a concrete batching plant in Cunupia. So said attorney Ramesh Lawrence Maharaj, SC yesterday as he made his submissions before Judge Mira Dean-Amorer during a trial at the High Court, Hall of Justice, Port of Spain.
Maharaj is representing a group of persons known as the Concerned Residents of Cunupia (CROC) who have taken legal action against the EMA for its decision to permit the operation of the concrete mixing plant at Chin Chin Road, Cunupia. The belt type concrete batching plant is owned by Motilal Ramhit and Sons/RPN Enterprises Ltd.
CROC members said they have been affected by noise and air pollution since the establishment of the plant in October, 2012, and that a facility of that nature does not belong in a residential community. The group is calling for the closure of the plant which is located near the Cunupia Government Primary School and the Cunupia Health Centre. There are also a church, a home for senior citizens and several agricultural farms nearby.
Apart from pollution, members also said that the Cunupia River was narrowed to accommodate the plant. As a result of this, they said, when rain falls heavily their homes are flooded.
Yesterday, Maharaj said the plant did not have a certificate of environmental clearance (CEC) and an environmental impact assessment (EIA) was not done to determine if the plant posed a threat to the environment, nor was public comment taken into account as required in Section 35 of the Environmental Management Act. The plant, as such, was operating against the law, he said.
