TIM and Brad Baldwin, of Sand, Gravel and Concrete, have applied to relocate their concrete batching plant from its Burnett Hwy creekside location to an industrial estate in Luthje Rd in Monto.
The move will protect the business from future flood events.
If the application is successful, there will be two new silos, conveyor belts and a control office at the 30 Luthje Rd address, currently used as a workshop.
It will be put to North Burnett Regional Council next month and the public has until September 4 to file submissions.
As it's a designated industrial zone, the proposal does not require an environmental impact assessment, and there is no right for appeal once North Burnett Regional Council has made a decision.
That has members of the Monto and District Ratepayers and Residents Association concerned.
President Lex Dow said he was stunned and could not believe the development, classed as a noxious industry, did not require an environmental impact assessment.
The ratepayers group is determined to change the nature of the application.
"We don't think those against the development have had enough time to write their submissions," Mr Dow said.
"The first I heard about it was in the paper last week.
"We are going to write to the council CEO and request more time, and for the project to be assessed under the impact not the code regulations."
Under an impact assessment the proposal would require an environmental assessment and the public would have appeal rights.
Council CEO Mark Pitt said the application was made under the old Monto Shire town planning scheme, and under those laws the development was classed as code assessable.
He said it would not be changed to impact assessable, but said environmental conditions may be added if the application was approved in the council.
A Department of Environment and Heritage spokesperson said the development was not an "environmentally relevant activity", although it would have to comply with general environmental guidelines in the Environmental Protection Act.
The Baldwins declined to comment until a decision had been made by the council.
