Two concrete mixer trucks destroyed in early morning fire

Two concrete mixer trucks were destroyed in an early morning fire at a concrete mixing plant on U.S. Highway 80.

 

A passerby on U.S. Highway 80 reported the fire just after 2 a.m. Tuesday, September 23, 2014, at the Lattimore Materials Company (LMC) which is located on the north service road of U.S. Highway 80 just west of Farm-to-Market (FM) 460. Upon arrival of the Forney Fire Department, two concrete mixer trucks were fully engulfed in flames. 

 

The fire damage was contained to the engine bay and passenger compartment of both trucks and was extinguished just after 2:20 a.m. A third truck sustained fire minor damage.

 

The Kaufman County Fire Marshal's Office is investigating the cause of the fire.

Pickles rejects proposals for east London concrete batching plant

Construction materials company Aggregate Industries UK and its subsidiary London Concrete had applied to the Council in December 2011 for approval of its detailed plans for a concrete batching plant, cement storage terminal, aggregate storage facilities, and outline plans for a 74 metre jetty and ship to shore conveyor, at Orchard Wharf on the river Thames.

 

In a decision letter dated 16 September (108-page / 643 KB PDF), Pickles agreed with the assessment of planning inspector David Nicholson, who had found that the proposals would have "a significant and harmful impact on the appearance and setting of the East India Dock Basin". Nicholson had concluded that the proposed buildings, which ranged up to 18 m in height and 100 m across, would be "massive and overbearing" and was critical of the apparent failure of the developers to consider "alternative layouts and arrangements of structures" that would be less harmful to their surroundings.

 

Pickles noted that the site was a "safeguarded wharf" under a policy in the London Plan. The Plan identifies Orchard Wharf as being capable of being made available for cargo handling, particularly for the handling of aggregates, which would constitute part of its use if permission was granted for the proposals. Pickles concluded that use of the wharf for small concrete batching plant was also supported by the London Plan and gave "considerable weight" to the policy support for its reactivation.

 

However the SoS concluded that, despite the benefits of the proposed reactivation of the wharf, the particular design of the plans meant that "the amount of the harm that the scheme would cause is likely to be unnecessary”.

 

Refusing permission, Pickles said that while "there is no reason to believe that it would not be possible to devise a viable scheme that would overcome much of the environmental harm ... due to poor design and layout, the specific appeal proposals would not accord with the development plan".

 

The developers have the right to challenge Pickles' decision within six weeks of the decision date.

Odessa concrete plant fights improper zoning charges

The owner of a concrete mixing plant that has been operating for years without the proper zoning or permits is hoping a mediator will stop the county from shutting him down.

 

In late June, Assistant County Attorney Kristi Sims filed an injunction to close A+ Concrete for zoning and code violations. County commissioners unanimously rejected A+ Concrete’s application for “vested rights” even though they admit county staff approved a building permit to add a mixing tower at the plant, which is just off State Road 54 in Odessa.

 

County employees said they never bothered to check the zoning on the property because a concrete batching plant had been operating there — illegally as it turned out — for years.

 

In addition to the improper zoning, the company had not filed a site plan or a stormwater plan with the county. Two of the buildings on the site were erected without a building permit, and all of the signs are illegal.

 

Last year the company submitted a site plan that would have addressed several of the violations, but commissioners rejected it. That’s when it applied, unsuccessfully, for vested rights.

 

David Smolker, attorney for the plant, filed a motion to send the case to mediation in October.

 

“I thought we made a reasonable suggestion at the end of the hearing,” Smolker said. “We asked the county to allow us to improve the site. The problem is dust, and we can’t cure it because we haven’t been allowed to.”

 

Smolker said most of the dust could be eliminated if the A+ could pave the property. “We also proposed extensive buffering by planting a row of cedar trees along the border with Ashley Lakes, and having all the trucks use S.R. 54 for access,” Smolker said.

 

But for the homeowners who live a few hundred feet of the plant, the only solution is for the plant to move.

 

“I don’t feel like there is any room for compromise,” homeowner Janet Felts said. She’s one of a half-dozen neighbors who registered as interested parties in the litigation, which allows them to attend the Oct. 2 mediation.

 

“I want to be a part of it, and I want to be heard,” Felts said. “I do feel like the county has culpability, too.”

 

Pierre Hebert, another neighbor, also plans to participate. “I want to make sure no one ignores the residents,” he said. “Now it’s the county against the business owner, and I don’t want them to get involved in the mediation and forget about the community that has to live with it every day. We get cement all over our cars. We’re breathing that stuff all the time.”
